Terms of Service
Klebb Cloud is a managed hosting service for Klebb, an open-source personal health dashboard, operated by a single developer from New South Wales, Australia. By creating an account you agree to these terms. They are short on purpose; the Privacy Policy and Refund & Cancellation Policy are part of them.
1. Not medical advice
Klebb is a record-keeping tool, not a healthcare provider, and nothing in it is medical advice. It is not a medical device and is not intended to diagnose, treat, cure, monitor or prevent any disease or condition. Charts, trends and reminders are for your general information only; they are not a substitute for advice from a qualified medical practitioner who knows your circumstances, and no doctor-patient relationship is created by using the service. Never disregard or delay professional medical advice because of something you saw in your dashboard. If you think you are experiencing a medical emergency, call 000 (Australia) or your local emergency number.
2. The AI assistant
Your instance includes an AI chat assistant, with optional voice input and output. Its responses are generated by a machine, not a human, and generative AI is known to make mistakes, including confident-sounding wrong answers about health data. Treat everything it says as informational only: verify anything that matters independently, and treat section 1 as applying to the assistant twice over. 3. Your account
One subscription runs one instance for one person. Sign-in is by passkey; keeping your passkeys and your email account secure is your side of the bargain, because your email address is the recovery root for everything. Give us an email address you actually control, and keep it current.
4. Subscription and billing
Klebb Cloud is a monthly subscription billed in advance through Stripe. It renews automatically each month until you cancel; the price is shown at checkout and on the pricing page. If a payment fails, Stripe retries; your instance stays up during retries, and if payment ultimately cannot be collected the subscription ends and the lifecycle in section 6 applies. If we ever change the price, existing subscribers get at least 30 days' notice by email first, with time to cancel before it applies.
If a charge doesn't look right, please email support@klebb.app before disputing it with your bank; genuine mistakes are refunded without drama. If a payment is reversed or disputed, we may suspend access to your instance while it's unresolved. Your data is not deleted during a dispute.
5. Cancelling
Cancel any time, yourself, from the dashboard: no email required, no exit fee, no retention offers. Cancellation takes effect at the end of the period you've paid for, and your instance keeps running until then. 6. Your data
Your health data is yours. We claim no ownership or licence over it beyond what is technically necessary to host it for you. You can export a complete encrypted copy at any time from the dashboard. After your subscription ends, your data is held untouched for 30 days (export or reactivate), then permanently deleted; an encrypted operational archive survives at most 7 days beyond that. If we ever shut the service down, you'll get at least 30 days' notice and a way to take your data with you.
7. Acceptable use
The service is for personal health tracking. Don't use it to attack, probe or overload our infrastructure or anyone else's, don't resell access, don't upload material that's unlawful to possess, and don't use the AI assistant to generate abuse. We may suspend an account that threatens the service or other customers, and we'll tell you why.
8. The software
Klebb's source code is open source under AGPL-3.0; nothing in these terms restricts your rights under that licence. These terms cover the hosted service: our infrastructure, the klebb.app site and branding remain ours.
9. Service availability
This is a small, carefully-run service, provided "as is" and "as available". We don't guarantee uninterrupted operation, and maintenance sometimes needs downtime; we keep it short. Support is by email at support@klebb.app on a reasonable-effort basis. If there is ever a significant outage, you'll get an honest explanation of what happened.
10. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profits or goodwill, arising from your use of the service. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where liability can lawfully be limited, it is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
11. Changes to these terms
If we change these terms materially, we'll email you at least 30 days before the change takes effect. If you don't like the change, cancel before it starts and it never applies to you. Continuing to use the service after the effective date is acceptance.
12. Governing law
These terms are governed by the laws of New South Wales, Australia. Each party submits to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them. If part of these terms turns out to be unenforceable, the rest still stands.
